2.2 Data Processing

We use trusted third-party service providers to support the operation of the Service. These providers are contractually obligated to handle your personal information in compliance with applicable privacy laws.

Specifically:

  • Microsoft provides our cloud hosting infrastructure. All personal information you provide is securely stored on Microsoft Azure servers.
  • Stripe processes billing transactions on our behalf. We share your name, email address, and company name with Stripe to facilitate payment. All sensitive payment details (e.g., credit card information) are entered directly by you and stored exclusively by Stripe. View Stripe’s Privacy Policy.

We do not share your personal information with any other third parties for processing, marketing, or analytics.

2.2.1 Use of AI and Data Privacy

GamePlan includes AI-powered functionality provided through the OpenAI API. We are committed to protecting the confidentiality and security of all user data, including information submitted through AI prompts.

We do not use any user data submitted to the AI for model training or improvement, and neither does our AI provider, OpenAI.

“Data submitted through the OpenAI API is not used to train OpenAI models or improve OpenAI’s service offering.”

Additionally, OpenAI may retain API inputs and outputs for up to 30 days to provide the service and detect abuse. After 30 days, this data is deleted unless legally required to be retained.

2.3 Business Transactions

If GamePlan is involved in a merger, acquisition, financing, or sale of assets, personal information may be disclosed to legal, financial, and business advisors or potential acquirers strictly as necessary to evaluate or complete the transaction.

Any such disclosure will be made under a confidentiality agreement or equivalent legal obligation, and personal information will be used only for the limited purpose of evaluating the proposed transaction and in accordance with this Privacy Policy.

If the transaction is completed, your personal information may be transferred to the acquiring entity as part of the business assets, subject to the same privacy protections described here.

3. Your Choices and Rights

You have the right to access and control your personal information. This includes the ability to:

  • Withdraw consent to the collection, use, or disclosure of your personal information at any time (note: this may limit your ability to use certain features of the Service)
  • Opt out of receiving promotional or marketing communications by following the unsubscribe link in our emails or by contacting us directly

Withdrawals of consent do not apply retroactively to data already processed in accordance with this Privacy Policy prior to the withdrawal.

All data is securely stored and processed on Microsoft Azure servers located in the United States. We rely on Microsoft’s enterprise-grade cloud infrastructure to ensure data availability, integrity, and security.

While our servers are located in the U.S., we comply with applicable Canadian privacy laws regarding the handling and protection of personal information.

5. Information Security

We employ industry-standard physical, digital, and operational safeguards to protect your information from unauthorized access, disclosure, or misuse.

We continually review and improve our security practices to align with evolving best practices and regulatory requirements.

6. Access and Control Over Personal Information

Under the Personal Information Protection Act (British Columbia), you have the right to:

  • Access the personal information we hold about you
  • Correct or update inaccuracies in your information
  • Change your communication preferences
  • Request the deletion of your personal information from our primary systems
